Terms and conditions of sale
1. Subject
These general terms and conditions of sale govern the sale of products offered on the website Qabano.comwebsite, edited by Tobias Sebastian Horning, a craftsman registered under SIREN number 930 116 611, domiciled at 455 Chemin de Salivet, 26460 Truinas, France.
2. Products
The products sold on the site are wooden toy kits and decorative objects to be assembled. Each product is presented with a detailed description of its main characteristics. Photographs are not contractual.
3. Prices
Product prices are quoted in euros (€), inclusive of all taxes. They do not include delivery charges, which will be specified before the order is validated. The seller reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time the order is placed.
4. Order
The buyer may place an order on the site by selecting the product of his/her choice. The order is confirmed once payment has been made. A confirmation email is sent to the buyer. The seller reserves the right to cancel or refuse any order in the event of a previous dispute or non-payment.
5. Payment
Payment for purchases is made by credit card via a secure payment platform. The buyer's bank details are never transmitted to the seller. The order will be validated only after confirmation of payment by the bank.
6. Delivery
Products are delivered to the address indicated by the purchaser at the time of ordering. We deliver to Metropolitan France, Germany, England, Austria, Belgium, Spain, Italy and Switzerland. For orders over €80, delivery is free. For orders below this amount, delivery charges apply depending on the destination. All our products are carefully packaged to ensure they arrive in perfect condition. We provide detailed information on our delivery methods so that you can order with confidence. Delivery is free for orders over 80 euros. Delivery times vary according to destination and shipping method. The seller undertakes to dispatch products within 5 working days of order confirmation. Delivery times are indicative and do not constitute a firm commitment on the part of the seller.
7. Right of withdrawal
In accordance with legal provisions, the buyer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify his decision or pay any penalties. To exercise this right, the buyer must inform the seller of his decision by e-mail to hello@qabano.com. Products are returned at the buyer's expense. Products must be returned in their original condition.
8. Refunds
In the event of retraction within the legal time limit, the purchaser will be reimbursed within 14 days of receipt of the returned products. Refunds will be made by the same means of payment used for purchase.
9. Warranties
Products are covered by the legal guarantee of conformity and the guarantee against hidden defects, in accordance with articles L217-4 et seq. of the French Consumer Code. In the event of a lack of conformity or hidden defect, the purchaser may return the product and obtain a refund or replacement.
10. Intellectual property rights
All elements of the site (text, images, illustrations) are the exclusive property of Qabano. Any reproduction or use, in whole or in part, is prohibited without the prior authorization of the owner.
11. Disputes
In the event of a dispute, the purchaser is invited to contact customer service at hello@qabano.com. If no amicable solution is found, the purchaser may have recourse to the European Commission's online dispute resolution platform at the following address http://ec.europa.eu/consumers/odr/ ..
12. Applicable law
These general terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
